These Terms of Service (“Terms”) govern your access to and use of Rostia (the “Service”), a staff-scheduling platform provided by Tirzah Motel Management (“Rostia”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.
The Service
Rostia provides tools for businesses to manage staff rosters, shift sign-in and sign-out, hours and payroll records, team communication, and related operations. We may update, improve, or change features over time.
Accounts and eligibility
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for safeguarding your login credentials and for activity under your account.
- Account owners and managers are responsible for the staff data they add and for ensuring they have the right to provide it.
- You must be authorised to act on behalf of the business you register.
Acceptable use
You agree not to misuse the Service. In particular, you will not:
- Use the Service unlawfully or in breach of these Terms.
- Attempt to gain unauthorised access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Upload content that is unlawful, harmful, or infringes the rights of others.
Trials, subscriptions, and billing
Rostia may offer a free trial and paid subscription plans. Details of any current trial period and pricing are presented within the Service. Where billing applies, charges and renewal terms will be made clear before you are charged.
Your data
You retain ownership of the data you submit to the Service. We process it to provide the Service as described in our Privacy Policy. You are responsible for the accuracy and lawfulness of the data you provide.
Intellectual property
The Service, including its software, design, and branding, is owned by Tirzah Motel Management and protected by applicable laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the Service.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose. Nothing in these Terms limits any rights you have under the New Zealand Consumer Guarantees Act 1993 where it applies.
Limitation of liability
To the fullest extent permitted by law, Rostia and Tirzah Motel Management will not be liable for any indirect, incidental, or consequential loss, or for loss of data, profits, or revenue, arising from your use of the Service.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or where necessary to protect the Service or other users. On termination, your right to use the Service ends; provisions that by their nature should survive will remain in effect.
Governing law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction over any disputes.
Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above and, where appropriate, notify you of material changes. Continued use of the Service after changes take effect constitutes acceptance.
